Karen Klein Bus Bullies Slapped With One-YEAR School Suspension

No one can accuse the Greece (N.Y.) Central School District of looking the other way when it comes to its disciplinary response to students bullying others.

The kids who harassed Karen Klein with a 10-minute barrage of vile verbal taunts that went viral were suspended for the entire 2012-13 school year.

The four seventh grade boys who bullied the 68-year-old grandmother to tears were all issued a one-year suspension from school, a one-year suspension from bus use and ordered to perform 50 hours of community service with the elderly.

They must also complete a bullying prevention program.

The four kids will be all sent to the District Reengagement Center - a special alternative education program - as the town is required to provide an education by law.

Klein received national attention after the video of the boys bullying her went viral. Sympathetic viewers donated hundreds of thousands of dollars to her.

She said from the beginning she did not want to press criminal charges, and that she felt sorry for the kids ... though she does not accept their apologies.

Don't worry, you're not the only one: Netflix is currently down, admins hard at work (Update: back up)

What to do on this Friday night? If your answer to that age old question was "Netflix," then you likely received a bit of a rude shock this evening upon discovery that the company's video streaming service is currently out-of-whack. If you're wondering why that is, it appears to be tied to some of Amazon's EC2 servers in Virgina losing power due to the bad weather there. As VentureBeat notes, it's a problem which is also affecting sites like Instagram and Pinterest at the moment. For its part, Netflix has acknowledged the issue via its Twitter account, to which it states, "We're aware that some members are experiencing issues streaming movies and TV shows. We're working to resolve the problem." So, there you have it. Now the only question that remains is whether you'll break out one of those red envelopes, fire up Hulu Plus or venture out to the theater to satiate your movie desires.

Update: @Netflix just tweeted that everyone should be back up, or will be shortly. The Amazon AWS dashboard indicates it's recovering as of 3:13AM, so all should be ready for your tilt-shifted Saturday brunch pics and subsequent dream board updates.

New Vilma lawsuit asks for quick appeal ruling

NEW ORLEANS (AP) ? Saints linebacker Jonathan Vilma is suing the NFL in federal court, claiming Commissioner Roger Goodell failed to make a timely appeal ruling regarding Vilma's season-long suspension in connection with the league's bounty investigation.

The lawsuit filed Saturday night in U.S. District Court in New Orleans also asks for a temporary restraining order to allow Vilma to continue working if Goodell upholds the suspension.

The suit contends Goodell has undermined "the integrity of the NFL and the Commissioner's office" by handing down punishments to Vilma and others based on evidence that is either flawed or cannot be substantiated.

It is the second lawsuit Vilma has filed in the matter. The first, filed in May and also in federal court in New Orleans, seeks unspecified damages from Goodell for defamation of character.

In his latest filing, Vilma claims that the NFL's collective bargaining agreement required Goodell to rule as soon as was practical following a June 18 appeal hearing. Because players, in protest, declined to present new evidence or argue their case in the hearing, Goodell should have been able to rule by June 25, the first business day after the record was closed in the matter, the lawsuit argues.

"We have not yet had an opportunity to review Mr. Vilma's improper effort to litigate a matter that is committed to a collectively bargained process," NFL spokesman Greg Aiello said. "There is no basis for asking a federal court to substitute its judgment for the procedures agreed upon by the NFL and NFLPA, procedures that have been in place, and have served the game well, for decades."

In his latest attack on the NFL's handling of the bounty probe, Vilma contends punished players have only been able to see less than 1 percent of 50,000 pages of documents the league said it has compiled. His suit also claims that the few key pieces of evidence the league shared are flawed, including printed reproductions of handwritten notes.

"The NFL's alteration of other documents evidences that the NFL cannot substantiate the suspension, and undermines the integrity of the process," Vilma's lawsuit states.

The lawsuit seeks to discredit a key piece of evidence outlining bounty pledges from before the NFC championship game against Minnesota in January 2010, and also takes aim at fired assistant coach Mike Cerullo, who, according to Vilma, produced the document for the league.

Cerullo had a vendetta against the Saints after his firing following the 2009 season, and resented that the Super Bowl ring he received had been made with imitation (cubic zirconia) diamonds, the lawsuit contends.

The lawsuit claims Cerullo created the document "well after the 2009 NFC Championship game and in an effort to gain revenge against the Saints."

The suit further contends that a "close associate" of Cerullo has confirmed that Cerullo retracted his previous claims about the bounty program "in a communication directly with Goodell that occurred in April 2012."

The lawsuit notes that Goodell has not shared notes from interviews with Cerullo. Goodell also did not produce Cerullo as a witness at the appeal hearing or acknowledge Cerullo's retraction.

However, Aiello has denied that key witnesses in the bounty probe have retracted statements.

Aiello also has said the NFL has not issued any gag orders. Vilma's latest lawsuit, however, claims the NFL has ordered suspended former Saints defensive coordinator Greg Williams not to speak with suspended Saints players, coaches or officials as a condition for his reinstatement.

The NFL has said that Williams, who is suspended indefinitely, organized a bounty system that offered cash for hits that injured opponents, and which ran during his three seasons as defensive coordinator in New Orleans from 2009-11.

A close friend and associate of Williams, who was present for at least one discussion Williams had with Goodell, contends Williams never acknowledged the existence of a bounty program, Vilma's lawsuit said.

Williams' associate also contends that Williams has no information corroborating NFL findings that Vilma offered a $10,000 bounty for knocking quarterbacks Kurt Warner or Brett Favre out of 2009-10 playoff games.

The same associate confirmed that Goodell ordered Williams not to speak about the bounty matter with other punished individuals, the lawsuit said.

Balotelli's maturity clear for Italy

KIEV, Ukraine (AP) -Mario Balotelli's two goals against Germany could well represent the best solo performance of the European Championship. One more goal in Sunday's final against Spain and he'll finish the tournament as its top scorer.

For a 21-year-old forward previously best known for his temperamental behavior, Euro 2012 has also been a personal breakthrough. And that hasn't gone unnoticed by the rest of Italy's squad, especially after he scored both goals in the 2-1 win over Germany in Thursday's semifinal match.

"Mario has done great," Italy captain Gianluigi Buffon said Saturday. "First of all, he's a player with an immense base of quality, which is a great starting point. Secondly he's become part of a group of great champions - and not only in just football terms - and thirdly because he's found a coach like ours, who has found more ways than one to get the best out of him.

"But most of the merit goes to him, because he wanted it and went after it," Buffon added.

Balotelli's improvement has been so rapid that it's been visible from one match to the next.

After opening the tournament with a frustrating night against Spain, and then getting benched after another disappointing performance against Croatia, he came on as a substitute and scored a spectacular bicycle kick in the win over Ireland that concluded the group stage.

In the quarterfinals against England, Balotelli played all 120 minutes and then converted the opening penalty of the shootout win with a perfect spot kick.

Still, those performances were nothing compared to the way he dominated the match against Germany, first by muscling past Holger Badstuber to head in a pinpoint cross from Antonio Cassano with the authority of a veteran. He then followed up by blasting in a shot with such sheer power that no spectator could not have been left in awe.

"He's found an environment where he can measure himself against great champions - champions that have won and who have made big sacrifices to win," Italy coach Cesare Prandelli said.

"There comes a time when you have to have the courage to accept advice and responsibility," Prandelli said. "In football terms, we've been clear. After the Croatia match, we asked Mario to do certain things, to play as more of a center forward, and he's doing them with great diligence."

Brief relief, long-term questions on student loans

Congress may have averted a doubling of interest rates on millions of new federal student loans, but the fix is only for a year, leaving students on edge over whether they'll face a similar increase next summer.

"It's scary," said Faith Nebergall, a student at Indiana University whose loans currently total upward of $20,000. "And it's unfair to kind of be kept in the dark as to how much money we owe."

Under the agreement, interest rates on new subsidized Stafford loans will remain at 3.4 percent. That's estimated to save 7.4 million students about $1,000 each on the average loan, which is usually paid off over 10 or more years.

In the short run, that means students can breathe a sigh of relief this summer. A year from now, however, those rates are set to rise to 6.8 percent. That automatic increase was approved by Congress when lawmakers signed off on a series of scheduled rate reductions five years ago.

"There are more struggling families and they need some assurances to feel OK about getting young people into and through college," said Kati Haycock, president of The Education Trust. "Congress aggravates everybody, creates lots of anxiety out there, and essentially gives us a one-year solution."

About $1.2 billion will be saved by limiting federal subsidies of Stafford loans to six years for students pursuing a bachelor's degree and three years for those completing an associate's degree.

Richard Vedder, director of the Center for College Affordability and Productivity and an economics professor at Ohio University, said that could have the positive effect of encouraging more students to complete their degree in a timely manner, while also allowing some flexibility for students who work and have families and need more time to finish.

But he sees a negative impact down the road. Vedder argues that lower interest rates contribute to the desire to borrow money, which he says has the adverse effect of enabling schools to raise their tuition. Some students with poor academic records and for whom college might not be the best fight might be inclined to enroll anyway. That could aggravate problems in the labor market, where there are many unemployed and underemployed recent college graduates.

"It makes political sense, but not economic sense," Vedder said.

The price of college tuition has skyrocketed in recent decades. Between 1982 and 2007, tuition and fees increased 439 percent while the median family income rose 147 percent, according to a report from the National Center for Public Policy and Higher Education. The price of in-state tuition at a public university has increased by more than 5 percent annually in the past 10 years. It jumped 15 percent between 2008 and 2010 alone.

Cuts to state education budgets have played a significant role in increasing those costs, particularly in recent years. How much influence the expansion of access to federal aid has played is less certain; many insist it plays none. An analysis this year by the American Council on Education concluded there is no evidence to suggest it has, and that any relationship between the two is incidental, not causal.

What is certain is that with the price of tuition continuing to rise, pressure will remain on Congress to keep rates low.

"I think anybody in higher education, whether it's people like me, college presidents, financial aid administrators, students and parents, would really like some certainty and predictability," said Terri Hartle, senior vice president for government and public affairs with the American Council on Education. "And that's something we really haven't had."

Nebergall, 21, said she expects to owe $20,000 or more on her federal loans by the time she graduates, and about the same in private loans as well. While she and her long-term boyfriend would like to move in together when she finishes school, Nebergall doesn't think they'll be able to afford it. He pays about $250 a month in student loans himself.

She said a rate increase next year could have a big effect.

"It's money I could put down on a security deposit on my own apartment," she said. "It's money I could be used to start my adult life."
